Terms of Service

The agreement between you and Couple, Inc. — covering your account, our plans and billing, recordings and content, community conduct, and how disputes are handled.

You, the buyer, may cancel this agreement, without any penalty or obligation, at any time prior to midnight of the original contract seller’s third business day following the date of this contract, excluding Sundays and holidays. To cancel this agreement, mail or deliver a signed and dated notice, or send a telegram which states that you, the buyer, are canceling this agreement, or words of similar effect. This notice shall be sent to: Couple, Inc., 25 Mountainview Blvd STE 206, Basking Ridge, NJ 07920. You may also cancel by email to support@team.couple.com.

Couple gives every member more time than that: seven days after any plan payment, with a full refund. Section 6 explains how. Please read these Terms of Service carefully before using Couple. By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy.

1

About Couple and these terms

Couple is an online dating and social platform operated by Couple, Inc., a Delaware corporation (“Couple,” “we,” “us,” or “our”), located at 25 Mountainview Blvd STE 206, Basking Ridge, NJ 07920, USA. These Terms of Service (“Terms”) govern your access to and use of the Couple platform, including our website, mobile applications, and all related services (collectively, the “Service”).

These Terms constitute a binding legal agreement between you and Couple. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to update these Terms at any time. If we make material changes, we will notify you when you next use the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, your only option is to delete your account.

2

Eligibility

You must be at least 18 years old to use Couple. By using the Service, you represent and warrant that you are 18 years of age or older. We do not knowingly collect or maintain information from anyone under 18. If we become aware that a user is under 18, we will terminate their account immediately.

By using the Service, you also represent and warrant that you are not required to register as a sex offender with any government entity.

3

Your account

You are responsible for maintaining the confidentiality of your account credentials. Please keep your password secure and log out at the end of each session. You are solely responsible for all activity that occurs under your account.

Account sharing is not permitted. Each account may only be used by one individual.

You may not use Couple for any commercial purpose, including to advertise products or services to other users. Companies and other organizations may not use Couple without our express prior written approval.

We reserve the right to terminate accounts that are inactive for an extended period of time, or for any other reason at our sole discretion, with or without notice.

4

Plans, pricing, and billing

Couple offers the following plans:

The All-In Plan$99.99 / 3 mo

Automatically renewing every three months.

The Wingman Plan$44.99 / 3 mo

Automatically renewing every three months.

Single Event Ticket$4.99

One-time purchase, no automatic renewal.

By subscribing to the All-In Plan or the Wingman Plan, you authorize Couple to automatically charge your payment method at the end of each three-month billing period until you cancel. The charge amount and renewal date will be disclosed to you at the time of purchase and in renewal reminder communications.

You will receive renewal reminder communications before each automatic renewal. For California subscribers, Couple will send an annual reminder via email disclosing the plan name, billing frequency, charge amount, and cancellation instructions, as required by California’s Automatic Renewal Law. For Delaware subscribers, Couple will provide advance renewal notice when your subscription extends beyond 12 months from your original sign-up date. All renewal reminders will include cancellation instructions and a direct link to cancel online.

If a renewal payment fails, we will email you and keep your plan active for seven days so you can update your card on the Account page. If the payment still has not gone through after seven days, your plan ends.

You may change plans on the Account page. An upgrade takes effect immediately: a new billing period starts that day, and the unused part of your current billing period is credited toward the new plan’s price. A downgrade takes effect at your next renewal, when you are charged the lower plan’s price. We will show you the amount and the date before you confirm.

All fees are charged in US dollars.

5

Cancellation

You may cancel your subscription at any time by visiting the Account page in your profile menu and selecting Cancel plan. Cancelling stops all future charges. Unless you choose a refund under Section 6, cancellation is effective at the end of your current billing period. You will retain full access to all plan features until that date, after which your subscription will not renew. You may resume your subscription from the Account page at any time before that date.

Single Event Ticket and Couple Coins purchases are one-time purchases. They do not renew, and they are not subject to cancellation or refund once purchased, except as described in Section 6.

6

Refunds

Seven-day refund

You may cancel a subscription within seven days of any subscription charge, whether it is your first payment or a renewal, and receive a full refund of that charge. This applies in every state, and it applies whether or not you have used your plan during those seven days.

To cancel with a refund, select Cancel plan on the Account page and choose the refund option, or email support@team.couple.com from the email address associated with your account and tell us you are cancelling. Your plan ends immediately, and any Couple Coins that were included with that payment and have not been spent are removed from your balance. Refunds are returned to your original payment method within 10 days of your cancellation.

The refund option on the Account page is available once per account. If you have used it before, email support@team.couple.com to request a refund.

After seven days

After the seven-day period, subscription fees are non-refundable. If you cancel later, your plan runs to the end of the billing period you have paid for, as described in Section 5.

Tickets and Couple Coins

Single Event Ticket and Couple Coins purchases are non-refundable, except where the law of your state gives you a right to cancel. If you believe you have been charged in error, please contact us at support@team.couple.com.

Your rights under state law

The seven-day refund is in addition to any rights you have under the law of the state where you live, and nothing in these Terms limits those rights.

California subscribers

Under California Civil Code Section 1694.1, you may cancel this agreement, without any penalty or obligation, until midnight of the third business day after the day you subscribed, by email to support@team.couple.com. All amounts paid will be refunded within 10 days of receipt of your cancellation notice.

Under California Civil Code Section 1694.3, if by reason of death or disability you are unable to receive all services for which you have contracted, you and your estate may elect to be relieved of the obligation to make payments for services other than those received before death or the onset of disability, and any amount you have prepaid for services you have not received will be promptly refunded to you or your representative. “Disability” means a condition which precludes you from physically using the services during the term of disability, verified in writing by a physician you designate and pay. If the physician determines that the disability will last less than six months, Couple may extend the term of your plan by six months at no additional charge instead of cancelling it.

New York subscribers

Under New York General Business Law Section 394-c, you may cancel this agreement without a cancellation fee within three business days after you receive a copy of it, by email to support@team.couple.com or by certified or registered United States mail to the address in Section 23. Any payments you have made will be returned within ten business days of receipt of your cancellation notice.

You may place your membership on hold for up to one year by notifying us in writing at support@team.couple.com.

Couple presents possible matches and events to its members and does not promise a set number of referrals each month. If Couple does not furnish you with any social referral for two or more successive months, you may cancel this agreement and receive a refund of all money you paid, less a cancellation fee of fifteen percent of the price you paid.

Couple is offered online throughout the United States and Canada. If you move your permanent residence to a place where Couple is not offered, email support@team.couple.com and we will cancel your plan and refund the unused part of your current billing period.

The Dating Service Consumer Bill of Rights is in Section 24.

7

California subscribers

California subscribers may cancel their subscription at any time using the online cancellation process available on the Account page of the profile menu, consistent with California’s Automatic Renewal Law (Business and Professions Code Section 17600 et seq., as amended effective July 1, 2025). Couple will send annual renewal reminders as required by California law.

To report complaints, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

8

Deleting your account

You may delete your account at any time by sending an email to support@team.couple.com from the email address associated with your account and requesting account deletion. Deleting your account also cancels your subscription, so you will not be charged again. Deleting your account does not by itself entitle you to a refund. Section 6 explains when refunds are available.

Note that deleting your account and requesting full deletion of your personal data are two separate actions. When you delete your account, your profile will be removed from the Service, but some information may remain on our servers in accordance with our data retention practices. To request full deletion of your personal data, you must expressly request this in your deletion email to support@team.couple.com. We will comply with all deletion requests to the extent permitted by applicable law.

9

Recordings and content

Couple records audio and video from speed dates and events on its platform. These recordings are made by Couple, not by users, and are the property of Couple.

By using the Service, you consent to being recorded during speed dates and events. You acknowledge that Couple owns all such recordings and may use them for the following purposes:

  • To power MatchMaker’s AI matching and coaching features
  • To generate your MatchMaker Report
  • To develop and improve our AI models and technology
  • For promotional and commercial purposes, subject to the explicit social media consent obtained through the post-date consent flow

You may withhold social media consent for any individual date without affecting your ability to use the Service. However, consent to recording for AI and operational purposes is a condition of using Couple.

You may not record, reproduce, or distribute any interactions, recordings, or other content from the Service. Violation of this policy may result in immediate termination of your account.

User-submitted content

Where you do submit content directly — such as profile photos, bio text, or messages — you retain ownership of that content but grant Couple a license to display and use it in connection with operating the Service.

10

Conduct and community standards

You agree to use Couple respectfully and in accordance with our Rules of Engagement.

The following are strictly prohibited and will result in immediate permanent ban from the Service:

  • Harassment of any kind, including bullying, intimidation, threats, sexual harassment, and stalking, whether on or off the platform
  • Hate speech or the display of hate symbols
  • Nudity or sexual content

Additional conduct requirements apply during live events, including but not limited to: remaining on video at all times, not recording or livestreaming events, not soliciting contact information from other users, not engaging romantically with hosts, and not advertising products or services to fellow attendees. Full conduct requirements are set out in the Rules of Engagement.

We reserve the right to terminate your account for any violation of these Terms, the Rules of Engagement, or any other conduct we deem harmful to the Couple community, at our sole discretion and without prior notice.

11

No spam

You may not engage in any activity involving spam on Couple, including uploading, posting, emailing, or otherwise transmitting unsolicited commercial messages. Violations may result in immediate termination of your account and legal action.

12

Safety

WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON OUR MEMBERS. We reserve the right to conduct background checks using available public records at any time. By agreeing to these Terms, you authorize any such check.

You are solely responsible for your interactions with other users. We reserve the right to monitor disputes between users but have no obligation to do so.

13

Our proprietary rights

The Service and all software, content, and technology used in connection with the Service are the proprietary property of Couple and its licensors. You may not copy, modify, reverse-engineer, sell, sublicense, or otherwise transfer any rights in the Service or its underlying software. You may only access the Service through interfaces we provide.

14

Communications

By creating an account, you agree that Couple may contact you by email, text message, phone, or other means regarding your account, events, platform updates, and promotional offers. You may opt out of promotional communications at any time by opting to “unsubscribe” from the communications themselves. You may not opt out of transactional or account-related communications while you maintain an active account.

15

Third party links and advertisers

The Service may contain links to third-party websites or resources. Couple is not responsible for the availability, content, or practices of any third-party sites. Your dealings with third-party advertisers found through the Service are solely between you and the advertiser.

16

Disclaimer of warranties

YOU USE COUPLE AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. COUPLE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COUPLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

17

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COUPLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLES, EVEN IF COUPLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

COUPLE IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. YOU RELEASE COUPLE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS ARISING OUT OF OR CONNECTED WITH ANY CLAIM YOU HAVE AGAINST OTHER USERS.

IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

TO THE EXTENT A COURT DISREGARDS ANY WARRANTY DISCLAIMER OR LIABILITY LIMITATION HEREIN, COUPLE’S AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE DOLLAR ($1.00).

18

Indemnification

You agree to indemnify and hold Couple and its subsidiaries, affiliates, directors, officers, employees, and agents harmless from any claim, demand, or damages, including reasonable attorneys’ fees, arising out of your use of the Service, your Recorded Content, your violation of these Terms, or your violation of any rights of another person or entity.

19

Disputes and arbitration

Any dispute relating to these Terms or the Service will be resolved by binding arbitration rather than in court, except that either party may bring claims in small claims court if the claim qualifies. This arbitration agreement is entered into pursuant to the Federal Arbitration Act.

YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT BY NOTIFYING US IN WRITING WITHIN 60 DAYS OF FIRST USING THE SERVICE. IF YOU DO NOT OPT OUT, YOU WAIVE THE RIGHT TO HAVE ANY DISPUTE HEARD BEFORE A JUDGE OR JURY IN COURT.

You agree not to participate in any class action or representative proceeding, either in arbitration or in court.

Arbitration will be conducted by a single arbitrator under the Consumer Arbitration Rules of the American Arbitration Association (AAA). If AAA is unable or unwilling to administer the arbitration, the parties will mutually select an alternative arbitration provider. The arbitrator’s award is binding and may be entered as a judgment in any court of competent jurisdiction.

Couple will pay all business-side arbitration filing fees and arbitrator compensation as required under the AAA Consumer Arbitration Fee Schedule. The consumer’s filing fee is capped at $225 per AAA’s Consumer Arbitration Rules, and fee waivers are available for consumers who cannot afford this fee. All other fees will be allocated per the AAA’s then-current fee schedule.

Any claim must be filed within one year of the event giving rise to the claim.

Canadian users

The arbitration provisions in this section apply to Canadian users only to the extent permitted by applicable provincial law. Residents of Ontario, Quebec, and British Columbia retain the right to pursue claims through local courts or applicable dispute resolution bodies under their respective provincial consumer protection legislation, notwithstanding the arbitration provisions above.

20

Canadian users

Consumer protection rights: Nothing in these Terms limits the rights of Canadian users under applicable federal or provincial consumer protection legislation.

Consent: By creating an account and using the Service, Canadian users expressly consent to the collection, use, and disclosure of their personal information as described in our Privacy Policy, including the transfer of personal information to the United States for storage and processing.

Governing law: While these Terms are governed by Delaware law, mandatory provisions of Canadian federal or provincial law that would otherwise apply to protect Canadian consumers are not displaced by this choice of law.

21

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

22

General

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver. These Terms, together with the Privacy Policy and Rules of Engagement, constitute the entire agreement between you and Couple regarding the Service.

These Terms were written in English. If you are reading a translation and it conflicts with the English version, the English version controls.

Dating Service Consumer Bill of Rights (New York)

New York General Business Law Section 394-c gives members in New York the following notice.

  • No social referral service contract shall require the payment by you, the purchaser, of an amount greater than one thousand dollars. In addition, no such contract may extend over a period of time greater than two years.
  • No social referral service contract shall require you, the purchaser, to purchase a good or service which is directly or indirectly related to the social referral service. These extra services are known as ancillary services and, while these ancillary services may be offered to you, the law prohibits the seller from requiring that you purchase this service as a condition of your social referral service contract.
  • If your social referral service contract costs more than twenty-five dollars, the seller must furnish a minimum number of referrals per month to you, unless your social referral service provides the user with a search functionality or is presented with possible matches. If this minimum amount is not furnished to you for two successive months, or in the case of an online dating service with search functionality or algorithm or location based matching, any social referral, you have the option of cancelling the contract and receiving a full refund of all the money you paid, less a cancellation fee which cannot exceed either fifteen percent of the cash price or a pro rata amount for the number of referrals furnished to you. Couple’s cancellation fee in that case is fifteen percent of the price you paid.
  • Unless your social referral service contract is for online dating services that are generally available to users on a regional, national or global basis, your social referral service contract must specify the distance which you, the purchaser, are willing to travel to meet any social referral. No social referrals shall be furnished where you and the referral live at a distance greater than the distance specified in the contract.
  • The provider must have an established policy to address the situation of your moving outside the area it services. This policy must be explained in your contract. Couple’s policy is in Section 6.
  • If any provision of the social referral service contract is violated, you have the right to bring a court action against the provider which has violated the contract.
